Test Drive Terms and Conditions

Eligibility

The Test Drive is available only to individuals who meet the minimum age requirements under the laws of the Kingdom of Saudi Arabia; hold a valid motorcycle driving license issued by a competent authority and legally recognized in the Kingdom of Saudi Arabia; and are legally permitted to operate a motorcycle within the Kingdom. Sharmax Motors reserves the right to verify the validity of driving credentials and identification prior to the Test Drive.

Deposit

Sharmax Motors may require a refundable security deposit prior to the Test Drive. The deposit amount and refund procedure shall be communicated before the Test Drive begins.

Purpose and Duration

The Test Drive is provided solely for the purpose of evaluating the motorcycle prior to a potential purchase. Sharmax Motors may limit the duration, route, and conditions of the Test Drive at its discretion.

Safety Requirements

The Test Driver must wear appropriate protective safety gear, including a helmet; comply with all applicable traffic laws and regulations of the Kingdom of Saudi Arabia; and operate the motorcycle responsibly and safely. Sharmax Motors may refuse or terminate the Test Drive if safety requirements are not met.

Risk Acknowledgment

Motorcycle riding involves inherent risks. By participating in the Test Drive, the Test Driver accepts responsibility for their conduct during the ride. Nothing in these Terms excludes liability where such exclusion is prohibited under the laws of the Kingdom of Saudi Arabia.

Damage and Insurance

The motorcycle may be covered by insurance subject to applicable policy terms. If damage occurs during the Test Drive as a result of negligence, misuse, or violation of traffic laws, the Test Driver may be responsible for the applicable insurance deductible and any damage not covered by insurance. Liability shall be determined in accordance with the laws of the Kingdom of Saudi Arabia and the relevant insurance policy.

Communications

By submitting a Test Drive request, the Test Driver agrees to be contacted by Sharmax Motors via phone call or messaging services (including WhatsApp) for the purpose of arranging and administering the requested Test Drive. Promotional communications shall only be sent where the Test Driver has provided separate consent, in accordance with applicable data protection and direct marketing regulations.

Data Protection

Personal data shall be processed in accordance with Sharmax Motors’ Privacy Policy and the Personal Data Protection Law (PDPL) of the Kingdom of Saudi Arabia.

Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Kingdom of Saudi Arabia.
